가압류
가압류는 금전채권이나 금전으로 환산할 수 있는 채권에 관하여 장래 그 집행을 보전하려는 목적으로 미리 채무자의 재산을 압류하여 채무자가 처분하지 못하도록 하는 제도입니다.
민사집행법상 가압류사건은 가압류할 물건의 소재지 지방법원이나 본안소송이 계속중이거나 앞으로 본안을 제소되었을 때 이를 관할 할 수 있는 법원 중 한 곳에 제출하여야 합니다. 강제집행에 관하여는 당사자의 합의에 의한 합의관할은 인정되지 않습니다.
가압류 집행기관 유체동산의 가압류는 집행관이 이를 집행합니다.
부동산 가압류의 효력
가압류된 부동산은 그 처분이 제한됩니다. 처분행위를 할 수 없는 것은 아니고 그 처분행위를 가지고 가압류 채권자에게 대항할 수 없다는 것입니다. 채권자는 판결 등의 집행권원을 받은 후, 부동산의 소유자가 변경되었더라도 해당 부동산을 경매에 부칠 수 있습니다.
따라서 채무자가 가압류된 부동산을 처분하기 위해서는 가압류 취소가 필요하며, 그러려면 채권자의 청구금액만큼의 돈을 해방공탁 해야 합니다.
이는 채무자에게 큰 타격이 될 수 있으므로 효과적인 압박수단이 될 수도 있습니다.
절차
가압류신청서 작성 - 법정사항이 기재된 가압류 신청서를 작성합니다.
가압류신청서 접수 - 작성한 신청서를 관활법원에 접수합니다.
담보제공명령의 확인 - 법원이 가압류가 이유 있다고 생각하면 채권자에게 담보제공명령을 내립니다.
공탁서 제출 - 담보제공명령의 내용에 따라 보증보험증권을 발급받거나 현금을 공탁하여 공탁서를 법원에 제출합니다.
